Bluestone Planning submitted an application for a Lawful Development Certificate (a CLEUD) to establish whether a premises could be operated lawfully as a physiotherapy practice, in the absence of a valid planning permission for the whole of the premises.
The application sought to certify the use of the ground floor and front parking / access as a Physiotherapy Practice (Use Class D1); the shared use of ground floor front door, hall and stairs to first floor level by the Physiotherapy Practice (Use Class D1) and residential accommodation (Use Class C3); the use of front two rooms at first floor level as Physiotherapy Practice (Use Class D1);shared use of landing, bathroom and toilet at first floor level by Physiotherapy Practice (Use Class D1) and residential accommodation (Use Class C3).
The onus of proof is on the applicant in these cases and therefore precision and affidavits were necessary, together with other documentary evidence to support the application.
The certificate was subsequently confirmed.
